AfD takes legal action against classification as confirmed right-wing extremist

After a failed attempt at summary proceedings, the Saxon AfD wants to defend itself with a lawsuit against its classification as a "confirmed right-wing extremist movement". The lawsuit against the State Office for the Protection of the Constitution was filed with the Dresden Administrative Court on March 27, as confirmed by a court spokesperson. The "Freie Presse" initially reported on the case.

AfD wants classification prohibited

The aim is to prohibit the Office for the Protection of the Constitution from classifying, observing, dealing with, examining and managing the Saxon AfD regional association as a confirmed right-wing extremist organization. The previous classification is also to be determined as unlawful. The Office for the Protection of the Constitution now has three months to respond.

"We are now being labeled as right-wing extremists by the government in public - on the basis of a secret report that is being withheld from citizens," said the Saxon AfD chairman Jörg Urban to the "Freie Presse". The report by the Office for the Protection of the Constitution was not published in full when the party was classified at the end of 2023. Urban called the accusations against his party "outrageous".

Successful attempt

The AfD had already tried unsuccessfully to defend itself against the classification by the Office for the Protection of the Constitution in summary proceedings. Here too, the Dresden Administrative Court was initially responsible, but did not find in favor of the party. The Higher Administrative Court (OVG) in Bautzen dismissed the appeal against the decision in January 2025.

In the opinion of the judges, there were sufficient factual indications that the AfD state association was pursuing efforts that were directed against the human dignity of certain groups of people and against the principle of democracy, according to the reasoning at the time.
