Instead of being governed by criminal law, abortions should become part of health care, according to a call by the Saxony State Women’s Council. “Women must be able to make self-determined decisions about their bodies and their lives,” said Grit Jandura, chairwoman of the Saxony State Women’s Council, according to a press release. “This also means that women who decide to terminate a pregnancy have access to good counseling and safe medical care.” The fact that abortions are regulated under the Criminal Code contributes to stigmatization and fails to acknowledge that this is a matter of health care, Jandura added. Abortions in Germany are regulated by Section 218 of the Criminal Code. According to this provision, they are generally illegal but not punishable within the first twelve weeks following counseling. An abortion is legal if it is performed for medical reasons—such as severe fetal malformations—as well as in cases of rape or when the pregnant woman’s life or physical or mental health is at risk.
