State Agency Finds Violations of Maternity Protection Laws

Maternity leave is governed by law—both in terms of specific time frames and protective measures. Numerous violations have now been identified during inspections.

In 2025, the Saxony State Directorate (LDS) identified 174 violations during inspections of maternity protection measures in companies. These violations included, for example, the prohibition on overtime and work between 8 p.m. and 6 a.m., missing or inadequate risk assessments, or a lack of places to rest, the LDS reported. If deficiencies are not remedied, this can result in a fine. However, most employers are responsible and grateful for guidance, the agency said.

A total of 1,134 workplace inspections were conducted. The agency received reports of 12,091 pregnancies, 531 fewer than the previous year.

Employers and employees benefit equally

The State Directorate is the competent occupational safety and health authority and advises pregnant and breastfeeding women as well as employers on maternity protection in the workplace. As soon as an employer learns of an employee’s pregnancy, they must report it to the competent supervisory authority in accordance with the Maternity Protection Act. The report can be submitted via an online form.

“We support companies in creating safe workplaces for expectant mothers,” emphasized LDS President Béla Bélafi. This benefits both employees and employers alike.

According to the LDS, maternity protection does not begin only when an employee announces her pregnancy. Employers must assess and design workplaces in advance so that pregnant and breastfeeding women can work there safely. An early risk assessment protects both mother and child and makes it easier to continue working.
